An Industrial design is a type of IP Protection that protects the ornamental or aesthetic design of an object. It covers the non-functional aspects of a product’s appearance, such as its shape, pattern, or configuration. Industrial Designs are granted to creators who have created new, original, and ornamental designs for an article of manufacture. The protection offered by an industrial design last for 10 years from the date of the grant.

An industrial design application protects the look and feel of the product or an article which adds commercial value to the product as it focuses on the consumer’s preference such as aesthetics, ergonomics and ease of use while the product designers are putting their time and effort into developing the product design.

THE DESIGNS ACT, 2000 of India defines “Design” means only the features of shape, configuration, pattern, ornament or composition of lines or colours applied to any article whether in two-dimensional or three-dimensional or in both forms, by any industrial process or means, whether manual, mechanical or chemical, separate or combined, which in the finished article appeal to and are judged solely by the eye; but does not include any mode or principle of construction or anything which is in substance a mere mechanical device, and does not include any trade mark.

Design Licensing and Commercialization

Industrial Design licensing refers to the process by which the owner of an Industrial Design (also known as the licensor) grants permission to another party (the licensee) to use the patented design in exchange for compensation. This compensation can take the form of a one-time payment, ongoing royalty payments, or a combination of both. An Industrial Design license agreement typically outlines the terms of the arrangement, including the scope of the license (e.g., specific products or geographic region), the length of the license, and any limitations on the use of the patented design. Industrial Design licensing can be a valuable way for the patent owner to monetize their invention and for the licensee to gain access to a patented design for commercial purposes.
