Patents
A patent is a monopoly right granted by the government to an inventor for excluding others from making, selling, offering for sale or importing the alleged invention in return of the public disclosure. A patent application is filed for an invention which as defined is “a new product or process involving an inventive step and capable of industrial application”. A patent application takes care of the functional and technical aspects of the product or process and must satisfy certain criterion below in order to be granted a patent.

Trademarks are distinctive signs used to distinguish between identical or similar goods and services offered by different producers or services providers and the distinguishing parameters can be artistic manner in which the logo or a name is designed, thus a trademark can be anything from combination of words, letters, and numerals, 3D symbol, combination of colors or even a fragrance and a unique musical note. Trademark provides a unique identity to your enterprise and most of the times is a valuable intellectual property for corporations.
Industrial Designs
An industrial design application protects the look and feel of the product or an article which adds commercial value to the product as it focuses on the consumer’s preference such as aesthetics, ergonomics and ease of use while the product designers are putting their time and effort into developing the product design. The Designs Act, 2000 provides the applicant of the design to claim the new or original subject matter. The industrial design can not be registered if it is not new or original and is mere combination of two designs or is non distinguishable from the existing designs.
